Parqo Booking, Cancellation and Refund Policy

1. Purpose
This Policy explains when a Booker may cancel a Booking, when a refund may be available, and how Parqo handles problems with a Booking.
This Policy forms part of the Parqo Terms of Service. The version of this Policy in effect when a Booking is confirmed governs that Booking, unless applicable law requires otherwise.
2. Definitions
“Booker” means a User who makes or intends to make a Booking.
“Booking” means a reservation for a Parking Space.
“Cancellation Cutoff” means the period before the Booking start time during which a Booker may cancel and receive the refund stated in the applicable Listing.
“Convenience Fee” means the fee charged to a Booker for using the Platform and related Booking services.
“Listing” means the information made available by the Owner through the Platform describing the Parking Space, including its location, availability, price, applicable restrictions, and other material information.
“Overstay Charges” means any additional charges applicable when a Booker fails to vacate the Parking Space at the end of the booked period, as disclosed in the applicable Listing or Booking.
“Owner” means a User who lists a Parking Space through the Platform.
“Parking Amount” means the amount charged for the Parking Space for the booked period excluding the Convenience Fee.
“Refund Request” means a request for Parqo to review a problem affecting a Booking rather than a voluntary cancellation.
3. Cancellation Before the Booking Starts
The cancellation terms applicable to a Listing will be shown to the Booker before payment and in the Booking confirmation.
Unless a Listing states otherwise:
(a) a Booker who cancels at least twenty-four (24) hours before the Booking start time will receive a refund of the Parking Amount;
(b) a Booker who cancels less than twenty-four (24) hours before the Booking start time will not receive a refund of the Parking Amount; and
A Listing may specify a different Cancellation Cutoff, provided the applicable term is clearly disclosed before the Booker confirms the Booking.
4. No-Show and Early Departure
Failure to use a confirmed Booking, arriving after the Booking starts, or leaving before the Booking ends does not by itself create a right to a partial refund.
If the Booker cannot use the Parking Space because the Parking Space was unavailable, inaccessible, materially different from the Listing, or otherwise could not be used for the booked purpose through no fault of the Booker, the Booker may submit a Refund Request under Section 5.
5. When the Parking Space Cannot Be Used
A Booker may request a refund when, through no fault of the Booker:
(a) the Parking Space is occupied or unavailable;
(b) the Booker cannot reasonably access the Parking Space because required access arrangements were not made;
(c) the Owner cancels or informs the Booker that the Parking Space cannot be used;
(d) the Parking Space materially differs from the Listing in a way that prevents its intended use;
(e) the Booker is required to leave the Parking Space during the booked period for reasons attributable to the Owner; or
(f) another circumstance occurs that materially prevents the Parking Service from being provided as agreed.
If the request is approved, Parqo will provide a full or proportionate refund depending on the circumstances.
6. Refund Review Process
A Booker should submit a Refund Request through the Platform as soon as reasonably practicable after discovering the problem and, where possible, while the Booking is still active.
The Booker should provide the reason for the request and may provide photographs or other evidence.
Parqo may ask the Owner and Booker for information and may review Booking records, messages, Listing information, and other reasonably available evidence.
Parqo will make a good-faith administrative determination based on the information available. The determination does not prevent a Booker from exercising rights against the Owner or pursuing any remedy available under applicable law.
7. Refund Amount
Where a full refund is warranted under this Policy, the Parking Amount paid for the affected Booking will be refunded. The Convenience Fee will not be included in the refund, except where Parqo attributes the refund to a Parqo error or to the Owner under section 8, in which case the Convenience Fee is refunded as well.
Where only part of a Booking was unusable due to no fault of the Booker, Parqo may provide a proportionate refund where appropriate based on the unused portion and the circumstances.
8. Owner-Attributable Refunds and Booker-Attributable Failures
Where Parqo determines that a confirmed Booking cannot be fulfilled due to an Owner’s act or omission, Parqo will refund the Booker in accordance with this Refund and Cancellation Policy and may recover from the Owner the Parking Amount attributable to the affected Booking. Examples include, but are not limited to, an Owner cancelling a confirmed Booking, failing to provide required access, listing an unavailable Parking Space, or materially misrepresenting the Listing.
No refund will be issued if a Booker cannot use a Booking due to the Booker’s own act, omission, or violation of rules made known to the Booker by the Owner. In such cases, the Parking Amount may still be paid out to the Owner, less any applicable Parqo fees. Examples of Booker-attributable failures include, but are not limited to: arriving in a vehicle different from the one specified in the Booking profile; failing to follow the posted or disclosed access rules of the Parking Space; arriving outside of the booked time window (e.g., arriving too early); parking in an incorrect stall or unauthorized area within the location.
9. Parqo or Payment-System Errors
If a Booking cannot proceed because of an error in Parqo’s Platform or a payment-processing or technical problem attributable to Parqo, Parqo will take reasonable steps to correct the problem and provide any refund required under the applicable terms and law.
Where the Payment Processor independently delays, reverses, or fails to process a payment or refund, Parqo will reasonably assist the Booker but is not responsible for delays outside Parqo’s reasonable control.
10. Force Majeure
If a Booking cannot be used because a Force Majeure Event prevents access to or use of the Parking Space, the Booker will receive a refund of the Parking Amount. For all other circumstances where a Booking cannot be used, including circumstances involving the Owner or Booker, any refund will be subject to the applicable refund request process and Parqo’s review under this Policy.
The Owner will not be treated as in breach solely because performance became impossible because of a qualifying force majeure event, provided the Owner did not cause or contribute to the event and complied with reasonable notification requirements.
11. Extensions and Overstays
A Booking may be extended only where the Platform allows an extension and the Parking Space remains available.
An extension becomes part of the Booking and is subject to the applicable charge.
A Booker who remains in the Parking Space after the Booking ends, including after any approved extension, may be responsible for applicable Overstay Charges, towing, building penalties, or other reasonable third-party costs resulting from the overstay.
A confirmed overstay also places a strike on the Booker's account. Strikes are counted over a rolling thirty (30) day period. A third (3rd) strike within any thirty (30) day period automatically suspends the Booker from making new Bookings for seven (7) days, after which the suspension lifts and the count begins again; Bookings already made are not affected. The Booker is notified of each strike, with the count, and of any suspension. Parqo may also suspend or reinstate an account under the Terms of Service; reinstatement resets the Booker's strikes.
12. How Refunds Are Paid
Refunds will be processed using the payment or refund method supported by Parqo and its Payment Processor.
Once a refund is approved — whether through a cancellation within the applicable Cancellation Cutoff or a determination under Section 6 — Parqo will initiate the refund within three (3) business days. Once initiated, the funds may take additional time to appear depending on the Booker’s bank or e-wallet provider and the Payment Processor.
Where a refund cannot be returned through the original payment method, Parqo may request a bank or e-wallet account in the Booker’s own name or use another lawful refund method.
13. Chargebacks and Duplicate Refunds
If a Booker receives a refund from Parqo and separately receives a chargeback or reversal for the same amount, Parqo may recover the duplicate amount, subject to notice and applicable law.
A Booker must not intentionally seek or retain duplicate recovery for the same transaction.
14. Policy Changes
Parqo may update this Policy from time to time. The version applicable to a Booking is the version presented or incorporated when the Booking is confirmed, unless a later change is required by law.
A material change will not retroactively reduce a Booker’s rights for an already confirmed Booking. Continued use of the Platform constitutes acceptance of the changes.
